By using this information system, I understand and consent to the following:
Therefore, by submitting this document this serves as my official no compete clause and I agree to company secrecy. I know and agree that this is my official no compete clause which I sign every time I log into the computer. I agree to use this system responsibly. I agree to professional secrecy and this is my formal non-disclosure acknowledgement. I am aware that I have an ethical and professional obligation to secrecy up into five years after my employment. This means both client information and company secrets. If I am found to use this information or any of the information thereof it can be punishable by termination or possible suit in the court of law. I agree that if I misuse this information or have any dealings with LeBlanc Consulting which may lead to a case in the court of law will be my sole responsibility to pay for all attorney and court fees for myself and LeBlanc Consulting. I agree that if I have questions about this system that I will contact LeBlanc Consulting Information technology department to get those questions answered and I will not consult with an entity outside of LeBlanc Consulting.
I agree and know that the direct contact time log/progress notes are to be typed immediately upon entering a client's home or within 5 hours to assist in the retention of important and sometimes critical information, only submit the contact log as I am leaving the client's home otherwise my hours will look short in the computer system. If I am entering the notes in the client’s home be sure to start filling out the note as I am communicating with the client as the computer times the amount of time I have spent at the client's home and can pinpoint My location as well. I agree that as I am going through the lesson plan use the tools on our database. I agree that I will log into the system when I enter the client's home since I know that the system allows us to see how long I am logged into the client IP address at their home. I agree that if I log onto this computer system from anywhere other than the client's home that this may be grounds for termination and I may be terminated without notice.
I am aware that if I do not bill at the time of services, my hours may not be paid. I am aware that that maximum hours I can work with clients is based on their service agreement and I shall not go over the amount of hours permitted daily unless approved by a supervisor. I agree that If I go beyond those hours provided within the service agreement without permission for a supervisor that I may not get paid. In other-words, I am not to work above 40 hours a week or 8-10 hours a day, or 160 hours per month. Absolutely NO exceptions. I am also aware that most of the time parenting hours are 20 per month and ILS hours are 40 hour per month per client depending on how the service agreement is written, however, it does not mean that all clients will have the same amount of hours. I will check with my supervisor to see if any of my client hours have been used so that I do not go over their allowed hours per month. I agree that if I go over the client hour that it may not be paid.
I am aware that if I am hired with LeBlanc Consulting I am considered a contract or an employee depending on how I was hired until my 1 year (12 month) probation period is up, therefore, If I am a contracted staff member I am aware that I will receive a 1099 at the end of the year ant not a W2. If I end employment or I am terminated before the 1 year (12 month) then I will be responsible for the finger prints both federal, state and cost of hiring such as the rolling fee. The total cost that will be deducted from my check for finger prints is approximately $145 depending on the Department of Justice Charge and $30 rolling fee. I agree that as indicated in our trainings and orientation, it is my responsibility to do my OWN review and turn it in the Human Resource by submitting it. Human Resources or Management will contact me to complete the review process. I agree that After my 1 year probation (12 month) period then I am considered permanent. I agree that LeBlanc Consulting still reserves the right to terminate services or assign clients and I may or may not be notified in advanced If I do not see my client for more than 5 business days or 7 consecutive days. I agree that disrupting client services without cause is a Breech of my Contract and employment. If a two week notice is given then the contract would be null and void since there would be time to replace the clients instructor. However, LeBlanc Consulting reserves the right to terminate me, my contract and or re-assign my client to someone else with or without notification to myself. By signing bellow I waive the right to notification of client assignment.
GROUNDS FOR IMMEDIATE TERMINATION: I agree that abuse of ANY form to a client or staff member (this includes verbal, and mental abuse. It will also be reported to adult protective services and may lead to criminal prosecution) is grounds for termination. I agree that Soliciting money at any time, for any reason, from clients or family members is inappropriate and grounds for termination. I agree that making purchases with the client’s money, unless a petty cash system has been established is grounds for termination. I agree that using the client’s home for personal use is grounds for termination. I agree that I will not invite friends or family to client’s home to stay during my shift. I agree that coming to work under the influence of alcohol or drugs is ground for termination. I agree that missing Team Meetings and Mandatory Meetings and Training's are extremely important and a part of my job and professional development, therefore not attending is grounds for termination. I agree that it is my responsibility to maintain my own computer and phone to do my job and attend meetings as the use of a working computer or phone is part of my job. I know that there may be extra charges with my phone carrier and LeBlanc Consulting is not responsible for the extra charges, minutes, or roaming fees that may occur as I use my computer or phone for work since I am agreeing to use my personal phone for work. I wave my rights to any wear and tear, or damages to the phone that I use for work. I am willingly I know that I must pay any extra charges on my own to attend our meetings via video chat, or conference call. I agree that our work depends on a strong team of whom can work together effectively and that insubordination, is not tolerated. I agree that refusing an assignment more than 3 times semi-annually or call in to cancel work more than 5 times within a month is grounds for termination. I agree that leaving a client’s home before the shift is over or before a replacement arrives.
I agree that sleeping on my shift unless my job description for overnight care permits it. I agree that using the client’s phone for personal use other than a family emergency is grounds for termination. I agree that canceling an assignment without acceptable medical explanations; I agree that I must not call into the office or anyone to request days off, instead I will fill out a leave request form located here and I must communicate the reason why I am requesting a leave. I agree that failure to arrive on-time for any assignment, unless office is otherwise notified is grounds for termination. I agree that failure to show-up for work, moving more than fifteen to twenty miles away from my clients, and failure to provide proof of residency or notify the company via leave request is unprofessional and cause for termination. Once terminated or separated, I agree that I am not permitted on the premises, nor to contact any of my clients or our staff members for 2 years, nor disclose any company trade secrets, practices, or of methods operation. I know that LeBlanc Consulting, Inc. is entitled to take legal action if it is revealed that I have disclosed such secrets during or after employment.
Furthermore, I agree that after my probation LeBlanc Consulting may or may not issue an ID Badge. If a Badge or ID is issued, to replace a lost or stolen card, or a card that was not returned at the end of employment, a processing fee of $35 will be deducted from your paycheck as per this contract.
Log into the computer as you arrive to the client's home, no later than 1-5 hours after services are provided and LeBlanc Consulting does not pay for time taken during lunch. If the note is NOT filled out in it's entirely then you will not be paid for services you are stating that you rendered. If you submit a note with the same information from the last time stating that you saw the client (cutting and pasting information) then the note will not be paid, if you submit all of your notes late or at the last minute (on the 30th and or its more than 5 hours its late) I agree that I will not be paid. If I state that I saw the client and bill for it, or bill excessively for researching for the client, and did not actually see the client then I may be terminated. I agree that I will have to reimburse LeBlanc Consulting for the monies paid to me even if this may have led to termination.
I agree with the 3 strikes I am out policy of client referrals to me. The 3 strikes I am out Policy refers to myself and my ability to perform my job duties to the satisfaction of the clients whereas it causes me to lose a client 3 times. If I have lost 3 clients LeBlanc Consulting will not provide another client and my employment with the company will be terminated. The three strikes I am out Policy also refers to my interactions with my peers as this is a community services environment that provides services to one of my nations most vulnerable population and if I am not able to get along with my peers it may also disrupt my interactions client services.
I am terminated, my last check will be direct deposited, handed to me, paid by cash ap, paypal or any other service providing funds immediately otherwise it will be left at the front desk of the Corporation or at the Department of Labor. My termination letter or direct supervisor will indicate how I can retrieve my last check. I agree that once I am terminated that I will not contact the company except in writing and by only contacting Human Resources, at [email protected] if there is no Human Resource Available I will write the Board of Directors at [email protected]
I agree that I will not contact the company for another client especially if I have lost my clients because working with the clients is my job, therefore, I am aware that I lost my job by my actions of violating company policy by losing clients. I know that each client has a POS that last up to one year and can be renewed until that client has become fully independent. I agree that as long as I am in good standing with work or my clients that there is a potential that I could be working with the client for years. Therefore, I agree that If LeBlanc Consulting discovers that I have not seen my client which causes the company to lose the purchase orders for that client then LeBlanc Consulting has the right to request the fees for the remainder of contracted POS, therefore, if the POS is dated to end on January 2025 and I lost the client before the end of the POS date that I am to pay the remainder of the POS to the company since it is considered potential income for the company and another worker that may have been able to assist the client.
I agree that any mistakes were made where I was paid more than what I worked, or if I falsely claimed hours that I did not work, or if I quit My job with LeBlanc Consulting the Company reserves the right to obtain its funds for up to 5 years from the date of services. I agree that if I refuse to repay the moneys for losing the clients or for the fraudulent claims then a letter will be sent to collections. After 3 collection attempts (3 months) A Lawsuit will be filed on the behalf of LeBlanc Consulting to obtain the money paid to me. I agree that if a law suit is filled, or any claim resulting in the company having to use a lawyer and I lose; LeBlanc Consulting has the right to obtain it's Attorney fees. I agree that if there is a special incident with my clients I will file a special incident report immediately, notify LeBlanc Consulting office and they will send it over to RCEB, or CPS. I agree that all information regarding clients is at a need to know basis. I know that Instructors may or may not be provided with full information about a client’s history or their files as per title 17.
Human Resource Notice: I agree that I have read and reviewed the material on this website including but not limited to the Labor Laws Notices located at the bottom of this page which includes the Human Resource Information and I give Permission to LeBlanc Consulting to provide a raise without notice: I agree that LeBlanc Consulting has permission to raise my salary, reassign my position or provide me with a bonus without notice. Therefore, once my Salary is determined and it's time for my review LeBlanc Consulting may provide my raise without notifying me or having me sign any documentation. Furthermore, I agree that I will paycheck my before contacting human resources or accounting and that I will not call human resource or accounting without having looked at my paycheck first. I agree to go through the chain of command for complaints and communication. I agree and acknowledge the meal and rest break policy and practice. I understand that the rest period requirements are as follows: If hours worked are less than 3.5 hours there are no rest periods required. If the hours worked are 3.5 hours to 6 hours there are one to 10 minutes paid rest period. If there are over 6 hours of hours worked up to 10 hours there are two 10 minute paid rest periods. If there are over 10 hours worked up to 14 hours there are three 10 minute paid rest periods. I agree that I know and have been provided information on how to access my pay check. - I have no reasonable expectation of privacy regarding any communications or data transiting or stored on this information system. At any time, the government may for any lawful government purpose monitor, intercept, and search and seize any communication or data transiting or stored on this information system.
- Any communications or data transiting or stored on this information system may be disclosed or used for any lawful government purpose.
- My consent is final and irrevocable. I may not rely on any statements or informal policies purporting to provide I with any expectation of privacy regarding communications on this system, whether oral or written, by My supervisor or any other official, except LeBlanc Consulting's Chief Information Officer.

I know if I am falsely claiming mileage or hours worked that this is fraud and can be pursued in the court of law. I agree that I am in the right mind and body when I am submitting my documentation and when I saw the client. I understand that any false misrepresentation of the clients, LeBlanc Consulting or the Regional Center of the East Bay can lead to prosecution and is subject to a law suit and paying legal fees. I certify that the consumer(s) listed above was/were provided the service as authorized for the stated periods, and that no additional charges were made to other parties. These claims are submitted under penalty of perjury in accordance with the terms and conditions below.
- The Provider agrees and shall certify under penalty of perjury that all claims for service provided to Regional Centers have been provided to the consumer(s) by the Provider.
- The services were, to the best of the Provider's knowledge, provided in accordance with the consumer's written Individual Program Plan.
- The Provider shall also certify that all information submitted to the Regional Center is accurate and complete.
- The Provider understands that payment of these claims will be from the federal and/or state funds and any falsification or concealment of a material fact may be prosecuted under federal and/or state laws.
- The Provider agrees to keep for a minimum period of five years from the date of service, a printed and/or electronic representation of all records which are necessary to disclose fully the extent of services furnished to the client.
- The Provider agrees to furnish these records and any information regarding payments claimed for providing the services, on request, within the State of California, to the California Department of Healthcare Services; Medi-Cal Fraud unit; California Department of Developmental Services; California Department of Justice; Office of the State Controller; U.S. Department of Health and Human Services, or their duly authorized representatives.
- The Provider also agrees that services are offered and provided without discrimination based on race, religion, color, national or ethnic origin, sex, sexual orientation, age, or physical or mental disability.
- The Provider agrees that they are in compliance with Welfare and Institutions Code Section 4514, Health Insurance Portability and Accountability Act (HIPAA), and all other applicable state and federal statutes and regulations regarding confidentiality of consumer information.
